1. Scope of Application & Provider
These General Terms and Conditions ("GTC") apply to all orders placed by consumers through the online shop of Tin Eller Studio | Kerstin Brueller (hereinafter "Tin Eller Studio") at kerstinbrueller.com.
Provider: Kerstin Brueller, Tin Eller Studio, 1220 Vienna, Austria (the complete address is available upon reasoned request, for data protection purposes).

These GTC apply exclusively to the purchase of products from the online shop — Fine Art Patches, Fine Art Charms, and other items listed in the shop. For individual commissioned work under a Fine Art Commission, the separate provisions in Section 7 apply.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a binding offer, but rather a non-binding invitation to submit an offer (invitatio ad offerendum). By completing the ordering process and clicking "order with obligation to pay" / "order now," the Buyer submits a binding offer to purchase.
The purchase contract is concluded once Tin Eller Studio accepts the order by means of a separate confirmation email or ships the goods. The automatic acknowledgment of receipt sent immediately after placing the order does not constitute acceptance of the contract.
3. Prices & Payment
All prices stated in the online shop are in euros. Exempt from VAT — small business status pursuant to § 6(1)(27) of the Austrian VAT Act (UStG). This applies for as long as the small-business status remains valid.
Shipping costs are shown separately before the order is completed and are not included in the product price. Payment is made via the payment methods offered in the shop, such as PayPal, Stripe, or instant bank transfer. Production and/or shipping begins only after full payment has been received.
4. Delivery & Shipping
Shipping takes place within 5 business days of receipt of payment, provided the ordered design is available. As Fine Art Patches are handmade in small batches, delivery times may be extended for designs in high demand or sold out. Any delay will be communicated separately.
Shipping is carried out primarily via Austrian Post (Österreichische Post). Depending on order size and weight, UPS, DHL, or Hermes may also be used to deliver to the address provided by the Buyer. Shipping costs are borne by the Buyer, unless stated otherwise during the ordering process. Pickup in Vienna is possible in exceptional cases by individual arrangement.
Loss of ShipmentThis provision applies exclusively to orders shipped with a tracking number. Should delivery of such a shipment fail to occur, an inquiry will be initiated by Tin Eller Studio with the shipping provider after three weeks from the date of shipment.
If, after four weeks from the date of shipment, the shipment still has not been received, the order will be reshipped once; Tin Eller Studio bears the shipping costs of the replacement shipment. Should the original shipment nevertheless arrive afterward, the Buyer is obligated to return this second shipment to Tin Eller Studio.
5. Retention of Title
The delivered goods remain the property of Tin Eller Studio until payment has been received in full.
6. Right of Withdrawal
Withdrawal NoticeThe Buyer has the right to withdraw from this contract within fourteen calendar days without giving any reason. The withdrawal period is fourteen days from the day on which the Buyer, or a third party named by the Buyer who is not the carrier, took possession of the goods.
To exercise the right of withdrawal, Kerstin Brueller, Tin Eller Studio, must be informed via email at hello@kerstinbrueller.com of the decision to withdraw from this contract by means of a clear statement. The enclosed model withdrawal form may be used for this purpose, but this is not required. To meet the withdrawal deadline, it is sufficient to send notice of the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of WithdrawalIn the event of an effective withdrawal, all payments received from the Buyer — including delivery costs, with the exception of additional costs resulting from the Buyer’s choice of a delivery method other than the least expensive standard delivery offered by Tin Eller Studio — will be refunded without undue delay and at the latest within fourteen days from the day on which notice of the withdrawal was received.
For this refund, the same means of payment used in the original transaction will be used, unless expressly agreed otherwise. No fees will be charged for this refund. The refund may be withheld until the goods have been received back, or until proof has been provided that the goods have been returned, whichever is the earlier point in time.
The goods must be returned or handed over to Tin Eller Studio complete, undamaged, and without undue delay, and in any case no later than fourteen days from the day on which the withdrawal is communicated. The deadline is met if the goods are sent before the fourteen-day period has expired.
The Buyer bears the direct costs of returning the goods.
The Buyer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
7. Exclusion of the Right of Withdrawal for the Fine Art Commission
For individual commissioned work under a Fine Art Commission — in which a design is developed and produced specifically according to the client’s personal specifications — there is no right of withdrawal pursuant to § 18(1)(1) of the Austrian Distance and Off-Premises Contracts Act (FAGG), as these are goods manufactured to customer specification that are clearly tailored to the personal needs of the client.
This exclusion applies exclusively to commissioned work. For the ready-made Fine Art Patches and Charms regularly listed in the online shop, the right of withdrawal under Section 6 applies without restriction.
8. Warranty
The statutory warranty provisions for consumers apply. The warranty period for movable goods is two years from delivery of the goods. Defects must be reported to hello@kerstinbrueller.com, stating the order details and, if possible, with photographic documentation.
Minor variations in thread work, color shade, or placement resulting from the handcrafted production process of the one-off pieces do not constitute a defect in the legal sense.
The statutory warranty covers exclusively defects that were already present at the time the goods were delivered, in particular material or manufacturing defects. Damage occurring only after delivery is not covered by the warranty, in particular damage resulting from normal wear, improper care or cleaning, improper handling, or failure to observe the care instructions set out in Section 9.
9. Fine Art Care Instructions
FINE ART CHARMS (Pendants) & PATCHESFixation — Ironing on fixes the position but does not replace sewing. Additional sewing with a few stitches along the edge is recommended, particularly for garments that are washed frequently.
Washing — The carrier fabric should be washed inside out and at a maximum of 30 °C, by hand or on a delicate cycle. Bleach, fabric softener, and tumble drying should be avoided. If the carrier fabric appears slightly wrinkled after washing, this is normal — it can be smoothed by ironing for a few seconds at 160 °C, with baking paper or a tea towel placed between the fabric and the iron.
Ironing — Ironing directly on the embroidered surface should be avoided, as this damages the threads. The best method is to place the carrier fabric in the desired position and fix it for one minute using circular motions at 160 °C, with baking paper or a tea towel between the fabric and the iron.
Cleaning — Dry cleaning is not recommended.
Drying & Storage — The piece should be dried lying flat and away from direct sunlight. Storage should be dry and free from prolonged exposure to moisture.
Fine Art Charm / Pendant — The stainless-steel carabiner is unaffected by these factors. The embroidered cotton base should be treated according to the points above.
These instructions are based on the materials used — Madeira rayon embroidery thread, cotton base, and interfacing — whose sheen, structure, and colorfastness can be affected by heat, chemical solvents, and direct sunlight.
FINE ART BUTTONS / PINS (not embroidered)Button pins are not washable. Cleaning may only be carried out by wiping with a dry or slightly damp cloth.
FINE ART JOURNAL STICKERSFine Art journal stickers are suitable exclusively for use on dry surfaces.
Loss while wornLoss of buttons, pins, or charms due to the fastening coming loose while being worn is not covered by the warranty. This constitutes a handling-related risk of wearing the item, not a product defect. No liability is assumed for such loss. Excluded from this are cases in which the fastening mechanism itself already had a manufacturing defect at the time of delivery — such a defect must be reported immediately upon receipt and thereby falls within the warranty period, see Section 8.
10. Liability
Tin Eller Studio is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For slight negligence, Tin Eller Studio is liable only for breach of material contractual obligations, with liability limited in amount to the foreseeable damage typical for this type of contract. Liability under the Austrian Product Liability Act remains unaffected.
Product SafetyButtons/pins and pin badges have a sharp pin and contain small parts that may pose a risk of injury or choking. These products are not suitable for children under 14 years of age and must only be used under adult supervision.
Small parts must be kept away from children under 3 years of age, as there is a risk of choking if swallowed. Responsibility for proper storage, use, and supervision lies with the parents/legal guardians as well as with the Buyer. No liability is assumed for injuries or damages resulting from improper handling or lack of supervision; the general liability provisions set out in the preceding paragraphs remain unaffected.
11. Copyright & Design
All designs, illustrations, and artwork on the Fine Art Patches and Charms are original works protected by copyright, created by Tin Eller Studio | Kerstin Brueller. The purchase of a Fine Art piece includes only ownership of the physical product, not the rights of use or exploitation in the underlying design.
Commercial reproduction, replication, or further processing of the designs is not permitted without express written consent and payment of a fee.

13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR platform), available at https://ec.europa.eu/consumers/odr. There is no obligation to participate in dispute resolution proceedings before a consumer arbitration board; however, Tin Eller Studio is willing to participate in such proceedings.
14. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the Buyer has their habitual residence remain unaffected.
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
